FAMILY LAW

It is no secret that Family Law is a difficult area of law due to the complex nature of the law itself and the high emotions involved. Our goal is to put you at ease and provide you with a thorough understanding of your rights and your options moving forward. We strive to keep the lines of communication open with our clients and to be accessible. Let us assist you with your needs in any of the following areas of family law:

Decision-Making Responsibility and Parenting Time: Whether you are newly separated or have been separated/divorced for a long period of time we can assist you with any custody or access claims you may have. We represent either parent who are trying to secure custody or trying to put in place a fair access/custody schedule. We also represent clients who have a claim brought against them for custody/access. If there is an emergency dealing with your child(ren) and you suspect that he/she may be in danger, please do not hesitate to contact us.

Grandparents' Rights to custody/access: We represent parents whose child(ren)'s grandparent(s) have brought a claim for access/custody. We also represent grandparent(s) whose grandchildren are being arbitrarily kept from them.

Child Support: We will assist you obtain child support, make changes to child support payments or terminate child support. We assist both parents with any child support issues they may have, including commencing a Court action if necessary. We have also had success in helping clients deal with retroactive claims for overpayment or underpayment of child support.

Spousal Support: If you are the support recipient or the support payor we are fully prepared and capable of assisting you with any issues you may have stemming from spousal support, including any retroactive claims you may have.

Division of Property: If you are legally married in Ontario then the law calls for the division of assets and liabilities after separation. This is called equalization. Equalization is one of the most confusing areas of law, as such we provide detailed explanations and try and keep the equalization process as transparent as possible. Whether you are a stay at home parent or an executive we can help you with any equalization issues you may have.

Agreements: A Separation Agreement is an agreement that parties enter into when they separate which can settle all issues including decision-making responsibility, parenting time, child and spousal support, property division and the matrimonial home. A Prenuptial Agreement (marriage contract) and Postnuptial Agreement sets out the parties financial roles/entitlements during marriage and in the event of the separation. We recommend that all common law couples enter into a Cohabitation Agreement to protect property. Due to the complexity of these Agreements it is always recommended that you seek assistance from a lawyer to ensure that your rights are protected.

Independent Legal Advice (ILA): If your partner/spouse has given you an Agreement drafted by a lawyer then we can provide you with a detailed explanation of the pros and cons of the Agreement. We will offer you a truthful analysis of the Agreement in relation to your needs and wants.

Matrimonial Home / Family Residence: Whether you want it to be sold or you want to engage in negotiation so that you can remain in the home you have grown to love, we are here to assist you

Restraining Orders/Domestic Abuse: We offer compassionate assistance to victims of domestic violence. When you contact us, we will ensure your confidentiality and provide you with whatever assistance you need, including information on resources in the community that may be of some assistance to you.

Uncontested Divorce: When both parties have agreed on all issues and have entered into a Separation Agreement or Minutes of Settlement, or if there are no children and property issues stemming from the separation, we will assist you in obtaining an economical uncontested divorce.

We can close your residential and/or commercial real estate transaction. Whether you are buying a home, selling a home, need to refinance your mortgage, or complete a spousal transfer, Tandem Law Professional Corporation can handle your real estate needs. We will help you understand your rights and obligations related to one of your most important assets. For certain transactions we offer mobile real estate services, this means that we will come to you to sign all the necessary paperwork to close your deal.

We offer a flat fee for the preparation of Wills and Powers of Attorney.
